Help us just say no to the proposed Wal-Mart on Cornwall Road, North Cornwall Township by joining our petition drive or signing the petition.  Wal-Mart founder Sam Walton stated: "If some community, for whatever reason, doesn't want us in there, we aren't interested in going in and creating a fuss."  It is up to the North Cornwall Residents to speak up, tell the Township and Wal-Mart NO and hold Wal-Mart to their word.  Don't think we can't defeat Wal-Mart; this has been done in Vermont and other parts of the country.  Over 100,000 communities have defeated Wal-Mart!

More development is proposed than 'just' a Wal-Mart

 

Unless the zoning ordinance is changed, commercial structures of *any size* cannot be precluded on the basis of size in the commercial area, much of which is owned by one developer in this area because there is currently no restriction on size or hours in the ordinances they want to re-adopt. The possibility exists there could be several stores of huge dimensions, which would bring huge volumes of traffic from people outside of our area to the 67 acres owned by Springwood Development Partners (immediately south of the proposed Wal-Mart site) - on top of the 13,000+ car trips daily projected by Wal-Mart. North Cornwall Township residents clearly stated that they wanted to curb commercial development in the survey taken prior to the adoption of the township's comprehensive plan. You can help STOP this from happening by attending the April 9 meeting and stating your objections and concerns for the safety of the township & other nearby municipalities.

You don't have to live in NCT to attend the meetings & hearings. Attend these meetings & hearings to let the supervisors know that you are opposed to re-adoption of C2 General Commercial zoning for Cornwall Road. This zoning is what allowed Wal-Mart to come to Cornwall Road. The zoning should more appropriately be 'Office & Institutional or a 'Neighborhood Business District' which restricts building size, hours of operations and prohibits gas stations and other high traffic businesses from coming to Cornwall Road. Public attendance and/or letters to the supervisors are even more critical than they were 2 years ago. We need a strong show of support. We can't afford to let a few developers and their attorneys run NCT and ruin our quality of life.

The conditional application, with conditions, was passed 2 to 1.  While Charles Brooks tried to convince us he was impartial, there was no good explanation why he stated in earlier newspaper articles that you needed someone like Wal-Mart to improve the roads.  Here's the newspaper article:

Despite the fact that the Wal-Mart application had more holes than Swiss cheese, it was approved!  However, Mr. Yoder pointed out that Charles Brooks should be recused which was denied, and that the attorney for the Township was making comments to favor the approval of the application by the Township.

This is far from over.  The Township's decision will be contested.  Our lawyers are working on an amendment to return the zoning of the proposed Wal-Mart site to its original status, and have presented a plan at the January 3rd NCT meeting.

 Now is the time for all concerned citizens to dig deep and make a contribution to Lebanon Citizens for Responsible Growth.



Final presentations were made on December 12.  The attorney for Wal-Mart gave his views why the conditional use application should be approved.  He included a promise that Wal-Mart would work with the residents to resolve any development issues.

Our attorneys presented three serious deficiencies in the Wal-Mart proposal:

  1. Wal-Mart chose to amend their second proposal presented in May after the hearings had been closed.  This is in conflict with the Township Ordinance.  Therefore, Wal-Mart has no proposal to consider and the application must be denied.
  2. Wal-Mart's second application as written did not comply with use on property zoned as C-2 in the Township Ordinance.
  3. The Township has written provisions in the Ordinance that all applications must not incur any factors that would be detrimental to the safety, health and welfare of the surrounding neighbors and community.  Our attorneys produced expert witnesses that construction of the proposed Wal-Mart would in fact present serious detrimental factors to the community, and therefore, the application must be denied.

Finally, any proposal MUST include a development plan.  Such a plan was absent from the Wal-Mart proposal.  Wal-Mart cannot simply say, 'We'll work that out later'.

Testimony was heard from residents and neighbors.  Everyone who spoke concurred to deny the Wal-Mart proposal, and additional facts were presented on the detrimental factors, to include traffic, safety, welfare and crime.  Click here for the summary in the Dec 14 Patriot News.

The documentary "Wal-Mart:  The High Cost of Low Price" was screened on Wednesday November 16, 2005 at Franklin and Marshal College, Stahr Auditorium as part of a worldwide network of more than 3,000 showings. The film features real stories told by the people who lived them:  Wal-Mart employees (from executives to floor level) shocked by abuse and discrimination, family owned businesses blown away by the Wal-Mart storm, even sweatshop workers in China and Bangladesh who produce the Wal-Mart apparel. State Rep. Mike Sturla discussed the impact of WM's business model on the state and the taxpayers.

Three main points were made at the Nov 16 presentation:

  1. Wal-Mart discriminates against women.  Most have dead end jobs.  Click here for the lawsuit.
  2. Wal-Mart lowers the standard of living and worker's wages when the set up shop.  Click here for the report.
  3. Wal-Mart expects us, the taxpayers, to pay for their employees' healthcare.  Click here for a report.
